‘Nothing wrong in not granting bail’ – CBI opposes plea of Rana Kapoor’s wife, daughters in HC

The Central Investigation Agency (CBI) on Wednesday arrested the wife and two daughters of Yes Bank founder Rana Kapoor in the Bombay High Court. Not granting bail by special court defended the decision. The Central Bureau of Investigation (CBI) on Wednesday told the High Court that there was nothing legally wrong in the special court’s refusal to grant bail to Rana Kapoor’s wife and two daughters. Earlier, the special court had denied him bail in the corruption and fraud case related to private sector financial company DHFL.

The CBI said this during the hearing of petitions by High Court Justice Bharti Dangre seeking bail of Kapoor’s wife Bindu and daughter Roshni and Radha Kapoor. On September 18, the special CBI court had refused to grant him bail. The court said that prima facie there is a loss of Rs 4,000 crore to the bank due to illegal activities.
The court sent the trio to 14-day judicial custody, saying they were not entitled to any sympathy as women or mothers of young children. All three are lodged in Byculla Women’s Jail. In the bail petition filed in the same High Court, the three women have questioned the decision of the special court not to grant bail. Senior advocate Mahesh Jethmalani, appearing for Bindu and Radha Kapoor, argued that arrest and custody is required only in special circumstances where there is a possibility of the accused absconding.
The counsel appearing for the probe agency argued before the high court that the special court was only ensuring the presence of the accused for the hearing. This is the reason why he was sent to judicial custody. According to the probe agency, during April-June in 2018, Yes Bank invested Rs 3,700 crore in short-term debentures of DHFL. In return, DHFL allegedly gave a bribe of Rs 900 crore to Kapoor as a loan. The loan was given to Doit Urban Ventures, a company controlled by Kapoor’s wife and their daughters.
